Zubaydah's legal team filed a lawsuit against Lithuania with the Strasbourg-based European Court of Human Rights (ECHR), the leading human rights tribunal in the world, over the country's failure to reopen an investigation into its role in Zubaydah's rendition to a CIA black site prison in Lithuania and the torture he was subjected to there in 2005.
But the DOJ on Wednesday told Zubaydah's lawyers they would not declassify and turn over to them a power-of-attorney form Zubaydah signed earlier this year authorizing his legal team to file the lawsuit against Lithuania on his behalf.
Interights said, "due to a communication ban imposed by the CIA, the U.S. Department of Justice and the Department of Defense that prevents him from publicizing the facts in his case," Zubaydah cannot "defend himself publicly."

Zubaydah was captured, along with 51 other alleged terrorists, during an early morning raid of a safehouse in Pakistan on March 28, 2002, in an operation conducted jointly by the CIA, FBI and Pakistani intelligence. The Bush administration said publicly after Zubaydah was apprehended that he was the No. 2 person in al-Qaeda, was involved in every major terrorist operation planned by al-Qaeda and was one of the planners of the 9/11 attacks.
A legal memo prepared by Justice Department attorneys Jay Bybee and John Yoo in August 2002, which authorized the CIA to use brutal torture techniques on Zubaydah, said because the Palestinian was "one of the highest ranking members of the al-Qaeda terrorist organization," torturing him was necessary to thwart pending attacks against US interests, which the CIA claimed Zubaydah knew about.
But in a stunning admission last year first reported by Truthout, the DOJ backed away from nearly every major claim the Bush administration made about Zubaydah, including his membership in al-Qaeda and his role in 9/11 and other terrorist attacks, stating in a court filing in response to a discovery motion filed by Zubaydah's attorneys in his habeas case that their "understanding of [Zubaydah's] role in terrorist activities has ... evolved with further investigation."

Hill & Knowlton immediately faxed details of her speech to newsrooms across the country, according to CBC's Fifth Estate's documentary. The effect was electric. The babies in incubator stories became a lead item in newspapers, and on radio and TV all over the US.
It is interesting that no one – not the congressmen in the hearing, or any journalist present – bothered to find out the identity of the young woman. She was the daughter of Kuwait's ambassador to the United States, and actually hadn't seen the "atrocities" she described take place. (When later confronted with the lack of evidence for her claims, the young woman said that she hadn't been in the hospital herself, but that a friend who had been there had told her about it. )
Similar unsubstantiated stories appeared at the UN a few weeks later, where a team of "witnesses," coached by Hill & Knowlton, gave "testimony" (although no oath was ever taken) about atrocities in Iraq. It was later learned that the seven witnesses used false names and even identities in one case. In an unprecedented move, the US was allowed to present a video created by Hill & Knowlton to the entire security council.

During the 1970s, I filmed secretly in Czechoslovakia, then a Stalinist dictatorship. The dissident novelist Zdenek Urb�nek told me, "In one respect, we are more fortunate than you in the west. We believe nothing of what we read in the newspapers and watch on television, nothing of the official truth. Unlike you, we have learned to read between the lines, because real truth is always subversive."
This acute scepticism, this skill of reading between the lines, is urgently needed in supposedly free societies today. Take the reporting of state-sponsored war. The oldest clich�is that truth is the first casualty of war. I disagree. Journalism is the first casualty. Not only that: it has become a weapon of war, a virulent censorship that goes unrecognised in the United States, Britain and other democracies; censorship by omission, whose power is such that, in war, it can mean the difference between life and death for people in faraway countries, such as Iraq.

This one would have cracked me up if it weren't so sad: "Mr. Obama said in response to a question about Iran: 'We believe that even if at the highest levels there was not detailed operational knowledge, there has to be accountability.'” Isn't that what so many 'truthers' have been saying for years about September 11 -- even if there was not detailed operational knowledge, where is the investigation? Where is the accountability? Is the irony completely missed on these people?

World Trade Center, a 47-story high rise that also collapsed for
unknown reasons. The steel apparently melted away, but no fire in any of
the buildings was believed to be hot enough to melt steel outright.
"A preliminary analysis of the steel at Worcester Polytechnic
Institute using electron microscopes suggests that sulfur released
during the fires -- no one knows from where -- may have combined with
atoms in the steel to form compounds that melt at lower temperatures.

The "dangers of trutherism"? Yes, it certainly would be dangerous to
actually look into what happened on 9/11 when nearly 3,000 innocent
Americans were murdered. And in case you are under the impression that
we have looked into it sufficiently, here's what some insiders have had
to say:
John Farmer, senior counsel to the Commission, said "what government and military officials had told Congress, the Commission, the media, and the public about who knew what when — was almost entirely, and inexplicably, untrue.... At some level of the government, at some point in time … there was a decision not to tell the truth about what happened."
Thomas Kean, the head of the 9/11 Commission, concurred: "We to this day don’t know why NORAD told us what they told us, it was just so far from the truth."
The two co-chairs of the Commission, Thomas Kean and Lee Hamilton, believe that the government established the Commission in a way that ensured that it would fail.
Senator Max Cleland, a Commission member who ultimately resigned, said, "If this decision stands [to limit 9/11 Commission access to White House documents], I, as a member of the
commission, cannot look any American in the eye, especially family members of victims, and say the commission had full access. This investigation is now compromised." He also called the commission "a national scandal" and said "one of these days we will have to get the full story because the 9/11 issue is so important to America. But this White House wants to cover it up."
One of the 9/11 widows called the Commission's work, "an utterly hollow report." Another widow guessed that about 30% of the families' questions had been answered.
Philip Shenon, a New York Times reporter who wrote a history of the 9/11 investigation said, "If the full truth is ever told about September 11, 2001, it will be the doing of the 9/11 families. It has not been told yet."
So the story has not be told yet. And The Nation has the nerve to try to discredit anyone who thinks that this is unacceptable? The "dangers of trutherism"? I don't think that's where the real danger lies and the bizarre twisting of the word "truth" itself is disturbing and sad.
